As of mid-2026, Idaho hasn’t enacted a Transfer on Death Deed for real estate. A 2026 bill, Senate Bill 1399, tried to add one but didn’t make it out of committee. So Idaho land can’t pass to an heir through a recorded TOD deed the way it can in a lot of neighboring states.
Because there’s no TOD deed, Idaho land usually passes another way. A revocable living trust or joint tenancy with right of survivorship are the common ones, and married couples can hold land as community property with right of survivorship under Idaho Code 15-6-401. No. Idaho doesn’t have a state estate tax or an inheritance tax. There used to be one, but that chapter of Idaho law, Title 14, Chapter 4, got repealed. So selling inherited Idaho land won’t trigger a state death tax.
Federal rules are separate and hinge on how big the estate is, and most estates come in under the federal exemption. There can be federal capital gains too, though inherited land usually gets a stepped-up basis to its value on the date of death, which tends to shrink the gain if you sell soon after.
